TERMS AND CONDITIONS FOR PRIME CELLAR WINE CLUB MEMBERSHIP

Terms and Conditions for Purchase:

In these terms and conditions, the "Company" will mean Prime Cellar and the "Customer" will mean any person, firm, company or body which places a purchase order with the Company. Please read these terms and conditions carefully before placing a purchase order. By placing a purchase order, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.

[A] General

It is illegal to sell alcohol to people under the age of 18. By placing an order, the Customer confirms that he/she is 18 years old or above. The Customer shall ensure that no person shall use his/her identity to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery or delivery shall be withdrawn and attempted at another time agreed.

The Company shall make every effort to ensure that prices, details and sizes of products on our website and wine list are up to date. Prices are subject to change without prior notice and all orders are subject to Company's acceptance at its sole discretion and stock availability.

The Company shall make every effort to ensure products displayed on the website and product list are in stock. If from time to time products become out of stock, the Company reserves the right offer alternative substitute products to the Customer of similar value and style.

Membership
To become a member:

1. Customer automatically becomes a Prime Cellar Wine Club Full Member with purchase for HK$1500 in a single transaction
2. Applicant must be 18 years or older
3. Membership is valid from the date of joining and automatically renew every year.
4. Prime Cellar reserves the right to change these Terms and Conditions without prior notice.

The Company has the absolute discretion to refuse membership of a potential customer and to terminate the membership of any customer for any reason whatsoever.

You must inform us immediately of any changes to the information that you provided when registering an order so that we can communicate with you effectively.

Breakage

The Customer is requested to examine the goods immediately upon delivery for any deficiencies and/or damages. Claims (if any) must be made at the time of delivery, otherwise any breakage shall be deemed to have occurred thereafter.

Refund Policy

It is the receiver's responsibility to check the condition of any goods received including glassware and accessories, at the time of delivery.  

We provide a full refund only for the corked wines with details follows:

1) Valid receipt within 7 days after receiving the wines

2) Wine purchase below HK$750(per bottle) or Vintage is less than 10 years old

3) Presentation of minimum 75% full of the corked wines(including the cork)

No returns shall be made on glassware or accessories after the receiver has acknowledged receipt of the goods.

[B] Payment Terms:

We accept payment by VISA, MasterCard, American Express and PayPal only.

All product prices listed are in HK dollars.

Your offer to purchase made at Prime Cellar may not be accepted subject to the availability of stock. A final and conclusive invoice will be presented to you upon delivery.

In the event a customer wishes to purchase goods not currently available at Prime Cellar (HK) inventory, a full (100%) advance payment will be required. Advance payment is non-refundable unless Prime Cellar is unable to locate the goods. However, under any circumstances, Prime Cellar reserves the right to cancel any order and make full refund to the customer .

Prime Cellar reserves the right to change the payment terms for any order without prior notice.

All risks in the products shall pass to the Customer upon delivery but Prime Cellar shall retain title in the products until full payment has been received.

[C] Delivery:

We offer free delivery (single location only limited to Hong Kong Island, Kowloon and the New Territories) for purchases over HK$2,000.

For orders under HK$2,000, a delivery charge of

• HK$150 shall apply for delivery to Hong Kong Island and Kowloon per delivery address.
• HK$200 shall apply for delivery to the New Territories per delivery address.

Delivery charge of HK$650 shall apply for delivery to the Outlying Islands per delivery address for all orders.

Customers will be contacted for any additional surcharge incurred for delivery.

Customers will be contacted for a nominated delivery schedule.

If the recipient is not available to receive the goods or present suitable identification, we reserve the right to decline delivery of goods.

Delivery service will be suspended when typhoon signal No.8 or above or a black rain warning is hoisted. In this event customers will be contacted to re-schedule delivery time.

We reserve the right to charge an additional delivery fee if the recipient is not available to accept delivery at the nominated the delivery time.

It is the responsibility of the member to notify Prime Cellar immediately of any change to their delivery address.

We reserve the right to decline delivery of goods to any customer at our sole discretion absolutely.

These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People's Republic of China and the Customer and Prime Cellar agree to submit to the jurisdiction of the Hong Kong courts. Prime Cellar may revise these terms and conditions at any time without prior notice. If any dispute arises, Prime Cellar's determination shall be final. Where these terms and conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.
